Terms of Service

These Terms are a binding agreement between you and Polaris. Please read them carefully — they cover how you may use the Service, how payments and payouts work, and important limitations on our liability, including a section on how disputes are resolved.

1. Agreement to these terms

These Terms of Service (“Terms”) govern your access to and use of the Polaris websites (including getpolaris.ca and app.getpolaris.ca), our iOS and Android apps, our waitlist, tools, and related services (together, the “Service”), provided by Polaris (“Polaris”, “we”, “us”, or “our”). By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of a company, you represent that you are authorized to bind that company to these Terms.

2. Who we are

Polaris is a professional network and hiring platform. Job seekers and professionals use Polaris to build a profile, get referred, get paid for referrals, and find work; companies use Polaris to post roles, source and screen candidates, and hire. We are based in Ontario, Canada, and can be reached at info@getpolaris.ca.

3. Eligibility

You must be at least 16 years old and able to form a binding contract in your jurisdiction to use the Service. By using it, you represent that you meet these requirements and that the information you provide is accurate, current, and your own.

4. Your account

Some features require an account, which you can create directly or through Google or Apple sign-in. You agree to provide accurate information, to keep it up to date, and to keep your credentials secure. You are responsible for all activity under your account. You may not create more than one account, share your account, or use another person’s account without permission. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe create risk for the Service or other users.

5. The Service

The Service includes a job-seeker app, a company hiring platform, and public tools such as job search, salary insights, and calculators. Features may be added, changed, limited, or discontinued, and some may be offered on a pre-launch, beta, or limited-availability basis. We do not guarantee that any feature, job, referral, hire, or other outcome will be available or produce a particular result. Some data we display (such as aggregated job listings and salary estimates) is provided for general information and may not be complete or accurate.

6. Subscriptions, billing & renewals

Certain features — particularly for companies — are offered on paid subscription plans (for example, Free, Pro, and Enterprise). Paid plans are billed in advance on a recurring basis (monthly or as otherwise stated) through our payment provider, Stripe.

  • Auto-renewal — subscriptions renew automatically at the then-current price until cancelled. You authorize us and Stripe to charge your payment method for each renewal.
  • Cancellation — you may cancel at any time; cancellation takes effect at the end of the current billing period, and you retain paid features until then.
  • Changes & proration — upgrades, downgrades, and plan changes may be prorated by Stripe. We may change plan prices or features on prospective notice; changes apply to the next billing period.
  • Taxes — stated prices may exclude applicable taxes, which will be added where required.
  • Refunds — except where required by law, payments are non-refundable and there are no refunds or credits for partial periods or unused features.

7. Referral bounties, earnings & payouts

Polaris lets companies fund cash referral bounties and lets individuals earn a share when a referred candidate is hired. Payments and payouts are processed by Stripe, including Stripe Connect for payouts. By funding, earning, or receiving money through the Service, you also agree to Stripe’s applicable terms.

  • Funding & escrow — a company funds a bounty up front, and eligible amounts may be held in escrow until a qualifying event, such as a confirmed hire, occurs.
  • Eligibility & verification — bounties, splits, and payouts are subject to eligibility rules, identity and tax verification, holding periods, and confirmation of the qualifying event as described in the Service. We may withhold, reverse, or cancel amounts obtained through fraud, error, abuse, chargeback, or violation of these Terms.
  • Fees — we may charge a platform fee on bounties and paid features, disclosed in the Service.
  • Taxes — you are responsible for determining and paying any taxes on amounts you earn, and for providing any tax information we are required to collect.
  • No guarantee — we do not guarantee any referral, hire, earning, or payout, or the conduct of any user, candidate, or company.

9. Your content & licence

You retain ownership of the content you submit — profile details, posts, messages, recommendations, job posts, and similar (“User Content”). You grant Polaris a non-exclusive, worldwide, royalty-free, sublicensable licence to host, store, reproduce, adapt, publish, and display your User Content solely to operate, improve, and promote the Service, consistent with your settings and our Privacy Policy. You are responsible for your User Content and represent that you have the rights to share it and that it does not violate these Terms or any law or third-party right. We may remove or restrict content that violates these Terms.

10. Acceptable use

You agree not to:

  • Post content that is unlawful, misleading, fraudulent, defamatory, harassing, hateful, or that infringes the rights of others.
  • Misrepresent your identity, employment, qualifications, or your relationship to any person, company, or job, or post fake jobs, referrals, or reviews.
  • Scrape, crawl, harvest, or collect data about users or the Service, or use bots or automated means except as we expressly permit.
  • Send spam or unsolicited or bulk messages, or misuse messaging, referrals, or outreach features.
  • Circumvent fees, escrow, or payout rules, or engage in money laundering or other financial abuse.
  • Interfere with, disrupt, probe, or attempt to gain unauthorized access to the Service, its security, or other accounts.
  • Reverse engineer, copy, resell, or create derivative works of the Service except as permitted by law.
  • Use the Service to discriminate unlawfully in hiring.

11. AI features

The Service includes AI-assisted features, such as a profile coach, résumé parsing, fit and hire-probability scoring, and recruiter agents that draft outreach and screen applicants. AI output may be inaccurate, incomplete, or unsuitable, is provided “as is” to assist you, and should be reviewed before you rely on it. You are responsible for decisions you make, and hiring decisions remain yours. You will not use AI features to generate unlawful, deceptive, or infringing content.

12. Job listings & third-party content

Some job listings and company information are aggregated from third-party and public sources and are provided for convenience. We are not the employer, do not endorse any listing or company, and do not guarantee that a listing is accurate, current, or genuine. Any application, interview, offer, or engagement is between you and the relevant company. Verify details independently before acting.

13. Intellectual property

The Service, including its software, design, text, graphics, logos, and the Polaris name and marks, is owned by us or our licensors and is protected by intellectual-property laws. Except for the limited, revocable, non-exclusive, non-transferable right to use the Service in accordance with these Terms, we grant you no rights in the Service, and we reserve all rights not expressly granted.

14. Feedback

If you send us feedback, ideas, or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use them without restriction or obligation to you.

15. Third-party services

The Service may link to or rely on third-party services (such as payment processing, sign-in providers, maps, advertising, and job sources). We are not responsible for third-party services, and your use of them is governed by their own terms and policies.

16. Privacy

Our Privacy Policy explains how we collect, use, and share personal information. By using the Service, you acknowledge our data practices as described there.

17. Termination

You may stop using the Service and delete your account at any time via our account-deletion page. We may suspend or terminate your access, with or without notice, if you violate these Terms, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends. Sections that by their nature should survive — including content licences, payment obligations, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.

18. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, that results (such as jobs, referrals, hires, or earnings) will be achieved, or that content or data will be accurate or reliable.

19. Limitation of liability

To the fullest extent permitted by law, Polaris and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or opportunities, arising out of or relating to your use of (or inability to use) the Service. To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) CAD $100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

20. Indemnification

You agree to indemnify and hold harmless Polaris and its affiliates from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to your User Content, your use of the Service, or your violation of these Terms or any law or third-party right.

21. Dispute resolution & governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. Before filing a claim, you agree to first contact us at info@getpolaris.ca and try to resolve the dispute informally in good faith for at least 30 days. If we cannot resolve it, the dispute will be subject to the exclusive jurisdiction of the courts located in Ontario, Canada, and you consent to their jurisdiction and venue. Nothing in this section limits any rights you may have under mandatory consumer-protection laws in your place of residence.

22. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above, and material changes may be communicated through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

23. General terms

  • Entire agreement — these Terms and the policies referenced here are the entire agreement between you and Polaris regarding the Service.
  • Severability — if any provision is found unenforceable, the rest remains in effect.
  • No waiver — our failure to enforce a provision is not a waiver of it.
  • Assignment — you may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
  • Force majeure — we are not liable for delays or failures caused by events beyond our reasonable control.
  • Notices — we may provide notices through the Service or to the email associated with your account.
